Léon Werth (1878-1955) was a French writer and art critic, friend of Octave Mirbeau, then of Antoine de Saint-Exupéry. First world war, colonisation, French "collaboration" during the second world war... Léon Werth wrote without kindness and with a great precision about the French society. Saint-Exupery met Werth in 1931 and soon he became the closest friend Saint-Exupery had outside of his flying group of Aeropostale.

Werth had not much in common with Exupery, he was anarchist, his father was Jew, and left Bolshevik supporter. Twenty-two years older then Saint-Exupery, with surrealistic writing style, author of twelve volumes, and many magazine pieces, he was opposite of what Saint-Exupery was.

Saint Exupery dedicated two books to him (Letter to a Hostage, The Little Prince) and referred Werth in three more. The dedication in the preface of The Little prince is one of the most charming dedications ever written. During the beginning of World War II, while writing The Little Prince Exupery lived in his apartment at downtown New York City, thinking about his France and his friends.

Leon Werth spent the war unobtrusively in Saint-Amour, his village in Jura, a montain région close to Switzerland where he "was alone, cold and hungry", without many nice words about French refugees. Saint-Exupery returned to Europe in early 1943, "I cannot bear to be far from those who are hungry ... I am leaving in order to suffer and thereby be united with those who are dear to me."

At the end of World War II, which Antoine de Saint Exupery didn't live to see, Leon Werth said: " Peace, without Tonio (Exupery) isn't entirely peace." Leon Werth did not see the text for which he was so much responsible until five months after his friend's death, when Galimard sent him a special edition.

I used to be a judge but I'm all right now . . .

LUNACY on the Bench is not as common as prime ministers and home secretaries stung by judgments critical of their policies like to suggest.

The fatalistic JBC letter which set the Panel Interview, Psychological and Psychiatric tests for Judge Florentino Floro for the vacant position of Guagua, Pampanga Regional Court Judge. On September 19, 1995, Judge Floro, in full trance, under LUIS, Armand and Angel, predicted before JBC Member Justice Jose Campos, that Atty. Teresita Cruz-Sison, mastermind of Judge Floro's 69 months suspension, would suffer the 1996 massive stroke, that JBC Member Francisco "Tito" Santiago, the husband of Justice Consuelo Ynares-Santiago would die the 1996 painful cardiac attack at Baguio City and JBC Member Justice Regino C. Hermosisima, Jr. would suffer a 1996 Supreme Court Stairs Accident. These triple Omen became the sole cause of Judge Floro's Immortality when he suffered the 69 months suspension and separation from judicial service on Angel's birthday on April 7, 2006

The recent decision of the Supreme Court of the Philippines to dismiss Judge Florentino V. Floro Jr as a judge of the Regional Trial Court in Malabon City because of a “medically disabling condition of the mind” that rendered him “unfit to discharge the functions of his office” repays careful consideration by any student of the judiciary.

Judge Floro first applied for appointment to the Bench in 1995. The mandatory psychological evaluation by the Supreme Court Clinic Services (memo to the Lord Chancellor: do not even consider this) revealed “evidence of ego disintegration”.

He reapplied in 1998, but the evaluation was again negative, identifying problems with self-esteem and mood swings.

But Judge Floro was allowed to rely on a more favourable assessment from private practitioners. He began work as a judge in November 1998.

The appointment was not a great success. Less than eight months later, the Supreme Court suspended Judge Floro while complaints against him were investigated.

Psychosis - ego disintegration

It took nearly seven years to complete the inquiries, partly because of the delaying tactics by the judge. In March Justice Chico-Nazario, for a unanimous 14-strong Supreme Court, decided that Judge Floro should be dismissed from the Bench.
In 1890 Mr Justice Stephen became incapable of acting in a judicious manner by reason of mental illness.

And in the 1950s, a High Court judge who lost his faculties was persuaded to resign only when no work was assigned to him. But there is, I think, no precedent for Judge Floro’s unusual manner of opening proceedings in his courtroom. A formal, “All rise”, or even a jocular, “Here comes the judge”, might be acceptable. But not the introductory statement to all those present in court that Judge Floro was “a Bar topnotcher” who passed the 1983 Bar Examinations “with an average score of 87.55 per cent”.

Judge Floro consistently earned Second Honors in the Ateneo Law School Dean's List, 1978-1982 and graduated FULL SECOND HONORS on April 7, 1982 with QPI of 85.11%

There would follow a reading from the Bible, after which Judge Floro would answer questions on the scriptural text of the day. The judge’s visiting card also stated that he was a “Bar exams topnotcher (87.55 per cent)” with “full second honours”. As the Supreme Court concluded, litigants might well interpret all this “as a sign of insecurity”.

What caused the Supreme Court most concern, and who can blame them, was Judge Floro’s belief that he enjoyed qualities lacked by other members of the judiciary.
Judge Floro is not the first judge to have an inflated opinion of his own abilities, but there are not many who have claimed special powers as “the No 5 psychic in the country”.
(The Supreme Court judgment unfortunately provides no information on whether the top four also have legal qualifications and, if so, what marks they obtained in the Bar exams.)

Judge Floro's 1999 Blue Robes: the Living Curse, Karma and Spell

In a variation of dress-down Fridays, Judge Floro changed from blue court robes to black each Friday “to recharge his psychic powers”. He was, he suggested, the angel of death and able to inflict pain and sickness on people appearing in his court (a valuable but perhaps disproportionate sanction in dealing with vexatious litigants).

The judge believed that he could write while in a trance, and he had, he insisted, “been seen by several people to have been in two places at the same time”, a very useful attribute in reducing the waiting lists for pending cases.

Most impressive of all, Judge Floro had made a covenant with “three dwarf friends named Luis, Armand and Angel”, who would, unseen by others, provide him with assistance in court (presumably when counsel were unable to provide a page reference in the bundles of evidence).

Very generously in the circumstances, the Supreme Court emphasised that it was not ruling that Judge Floro was insane. He was merely suffering from a psychosis that appeared to “cloud his judgment” and so undermined his competence and objectivity.
Justice Chico-Nazario concluded that psychic phenomena, “even assuming such exist” (a wise judge never decides more than is necessary to dispose of the case), have no place in jurisprudence.

Though it would, I suppose, be helpful to be able accurately to predict how the Supreme Court would deal with a case, and so avoid the expense and delay of waiting for their decisions.

The Supreme Court let Judge Floro down from the Bench as lightly as possible. No one is to blame as “we cannot condemn people for their faulty genes and/or adverse environment — factors they have no control over”.

David Pannick QC (born 7 March 1956) is a leading barrister in the United Kingdom. He practises mainly in the areas of public law and human rights. Pannick was educated at Bancroft's School and Hertford College, Oxford, where he graduated as a MA and a BCL.

Who is LUIS?

Without any illness, he died just of cardiac arrest. Eye Grades and Pulse Rates

It was only on 1992 that Judge Floro was infused to have seen the lights, and after near-death experiences: a) his eye grades (which was 325 – 275 from 1966 until 1992) was suddenly reduced to 175 – 125 in just 6 months). Judge Floro at that time was diagnosed by Dr. Eusebio, EENT, the best eye doctor of University of Santo Thomas Hospital with symptoms of glaucoma , a blinding disease. In 2007, Judge Floro’s eye corrective lens miraculously dived to 75 – 25 with astigmatism.

Betaxolol (trade names Betoptic, Betoptic S, Lokren, Kerlone) is a selective beta1 receptor blocker used in the treatment of hypertension and glaucoma. What does the covenant mean?

The pre-destined covenant and date / time, were conceived at the time of the birth of these 3 angels (they were born even before man was created, in Genesis). What is this dalliance all about? Simply put: as King of Kings of elementals, LUIS entered into a contract which expires after the death of the instrument or ward Judge Floro, but with respect to Armand and Angel, the shield ends at the time of death of his demise.

I remember you speaking of the higher light before. I have only seen the very clear fine brilliant "Small point of bright violet light" only once in my life. I did not mean to say I see that that type all of the time....... only once have I seen the pinpoint high brilliant light like a little violet sun that stayed for a few seconds and was gone. The violet light I see regularly is more like a scattered patch of violet color not very clear somewhat blurry.

The Brown and Red Lights

Parenthetically, the lower or inferior brown lights were / are regularly flashed, also, since 1992. However, Judge Floro was able to have seen the most brilliant red lights only once in his lifetime. Midnight Flashes of White Lights since 1997

The foregoing account of the bluish-Violet and white lights, which were / are regularly or daily flashed and seen by Judge Floro since 1997, are truly different from the white, yellow and other kinds of lights LUIS flashed when his were closed before he sleeps during midnights, and since 1997. 1. “I first saw these lights on or about 1996. I was visited by the phenomena twice (irregularly) a month, more or less. It was on March 1, 1996 that I first saw these 2 unseen little friends via psychic vision (while asleep, and before dawn).

2. I began writing about these lights on January 24, 1997. Essentially, most consists of only 4 colors – red, white, blue, and yellow. On almost all occasions, the lights flashed after I would rest and while awake, usually at 12 midnights and oftentimes, at 2:00 a.m., more or less, and while my eyes are closed. They range from very intense, very bright or extremely bright, but due to the velocity or speed, the appearance is quite less bright. Sometimes, only one of my eyes does see the lights.

January - 24 - Red (ish/yellow);
February - 7 - at Baguio (Venus Hotel) – I saw LUIS and Armand, as poor little school boys (wearing brown khaki pants); - 9 – at Banaue, Sanafe Lodge, and the 2 little fingers shook my 2 right little fingers; - I again saw 2 rich little boys; - 24 – Blue / gray – 12 midnight; - 2:00 a.m. I was awakened and ran, as if there were friends at the windows;

March – 1 / 2 – Bluish (left eye); Reddish (Yellow); (It was March 1, 1996 or a year ago that I saw these 2 unseen little friends); 22 – Light yellow; 24 – MR. ANTONIO Z. ATIENZA, JR. was allegedly kidnapped for RANSOM;

April 5 – First Saturday – yellow; 7/8 – Blue; I saw a Golden/Copper ring with “MAYA”; 9 – For the first time in my life, I was awakened at past 12 midnight, when I clearly saw my room illuminated, yellow, and suddenly, I saw a very bright RED glimmering light (it appears as clear LASER like CIRCLE RED), at the wall beside my bed, for about 20 seconds, and afterward, all the light disappeared; I also saw a horse with hoof, as I took off dirt from the toe/shoe; 10 – 7 a.m. I saw my deceased mother, CWL uniform, she was very nervous for Robert; this is the 42nd time I saw her while I saw her before on Feb. 5, wearing duster – green and white small squares ½ body to feet; 11 – Lightning white over / above my eyes; 12 – Yellow (left eye); I saw a horse (Dan’s parents rode my car, he drived and …. *** On January 1, 1997, I predicted a painful event to Lily the wife of Ric, my security/aid (at Alido for 3 days); On May 21, 22, 23, Ric informed Lily that I already predicted his death and he will not live for more than 42 years old, and Ric saw me thus; On May 24 (3:00 p.m.), I wore all black clothes and predicted a sad event.

Ric accidentally tripped over a child and brought him to the Marcelo Hospital but he was murdered by 4 men. It was May 24; at 6:00 p.m. I felt the throb; this was later televised at GMA-7, Brigada 7;

Finger-wagging Judge Floro warned his enemies - I told you so!

The original typewritten signed document "Erap will not finish his term" which was displayed by Judge Floro at his Court sala on December 20, 1998. At 12 noon Good Friday, 1998, Judge Floro wore all-black clothes and run the 2 1/2 kilometers San Juanico Bridge, Leyte-Samar, shouting-predicting "Erap will not finish his term."

On October 10, 2000, Judge Floro, in the Supreme Court investigation, testified under oath, before Acting Investigator Justice Romulo S. Quimbo, that Erap will not finish his term on 2001, but will remain in power in 2000. Floro further swore that the impeachment trial would be immaterial and irrelevant to his fate.

Based on the foregoing, the OCA, thru Justice Pedro A. Ramirez, reported that:

Upon the testimony of his own witnesses, Drs. Eduardo T. Maaba, Ma. Nieves Celeste and Eduardo L. Jurilla, respondent Judge Florentino V. Floro, Jr. is unfit because of insanity to remain in office as Judge of the Regional Trial Court, National Capital Judicial Region, Malabon, Metro Manila, Branch 73.

It is weird for respondent Judge to state in one of his pleadings in this case that President Estrada would not finish his term as President. It is unusual and queer of him to state in his calling card that he is a graduate of Ateneo de Manila, second honors, bar topnotcher with a grade of 87.55% and include in his address the name Colonel Reynaldo Cabauatan who was involved in a coup d’etat attempt. So is it strange of him to make use of his alleged psychic powers in writing decisions in the cases assigned to his court.

Judge Floro's enemies are frustrated when their loved ones suffer lingering illnesses and horrible deaths due to the mystic curse of the Philippine Angel of Death

It is improper and grandiose of him to express superiority over other judges in the course of hearings he is conducting and for him to say that he is very successful over many other applicants for the position he has been appointed. It is abnormal for a Judge to distribute self-serving propaganda. One who distributes such self-serving propaganda is odd, queer, amusing, irresponsible and abnormal. A judge suffering from delusion or hallucination is unfit to be one. So is he who gets into a trance while presiding at the hearing of a case in court.

One need not be a doctor of medicine, a psychiatrist and a psychologist to determine and conclude that a person in such circumstances is mentally unfit or insane and should not be allowed to continue discharging the duties and functions of a judge. The life, liberty and property of the litigants in the court presided by such judge are in his hands. Hence, it is imperative that he is free from doubt as to his mental capacity and condition to continue discharging the functions of his office.

RECOMMENDATION

WHEREFORE, it is respectfully recommended that by reason of insanity which renders him incapable and unfit to perform the duties and functions of Judge of the Regional Trial Court, National Capital Judicial Region, Malabon, Metro Manila, Branch 73, respondent Florentino V. Floro, Jr. be REMOVED and DISMISSED from such office.

Current practice

Today hypnotherapists, psychiatrists, psychotherapists, psychologists, sports psychologists and NLP practitioners, amongst others, use various forms of trances.
Neurolinguistic Programming (or NLP) is a further development of Milton Erickson's hypnotherapy, for which, however, he did not provide an orthodox methodology. Erickson would put his patients in trance with short stories.

While keeping the ego of his patients occupied, he would target his healing messages straight at their unconscious mind, which he believed to have considerable self-healing powers. In this way he healed himself of the paralysis that affected him when young and to which he did finally succumb later in life.

Beta wave, or beta rhythm, is the term used to designate the frequency range of brain activity between 12 and 30 Hz (12 to 30 transitions or cycles per second). Consciousness

Beta brain waves designate the general state of waking consciousness. As a consequence, this state has been 'normalized'. This normalization is a challengable value judgement. This consciously awake beta state may still be considered as a trance because it involves the selective filtering of information and utilizes cognitive, awareness and mentation resources in specific ways.

Kinds

* Communion: In the monotheistic tradition, ecstasy is usually associated with communion and oneness with God. Indeed, ecstasy is the primary vehicle for the type of prophetic visions and revelations found in the Bible. However, such experiences can also be personal mystical experiences with no significance to anyone but the person experiencing them.

* Rapture or Religious ecstasy: is an altered state of consciousness characterized by greatly reduced external awareness and expanded interior mental and spiritual awareness.

This is frequently accompanied by visions and emotional/intuitive (and sometimes physical) euphoria. Although the experience is usually brief in physical time, there are records of such experiences lasting several days or even more, and of recurring experiences of ecstasy during one's lifetime. Subjective perception of time, space and/or self may strongly change or disappear during ecstasy.

Stigmata: In his paper Hospitality and Pain, iconoclastic Christian theologian Ivan Illich "Compassion with Christ... is faith so strong and so deeply incarnate that it leads to the individual embodiment of the contemplated pain." Illich's thesis is that stigmata manifests from exceptional poignancy of religious faith and desire to associate oneself with the suffering Messiah. Interestingly, stigmatics have manifested the Holy Wounds in different bodily locations possibly due to subjective interpretation or envisioning.

*In hagiography (writings on the subject of Christian saints) many instances are recorded in which saints are granted ecstasies. According to the Catholic Encyclopedia[1], religious ecstasy (called supernatural ecstasy) includes two elements: one, interior and invisible, in which the mind rivets its attention on a religious subject, and another, corporeal and visible, in which the activity of the senses is suspended, reducing the effect of external sensations upon the subject and rendering him or her resistant to awakening.

*Edgar Cayce (1877 – 1945) was an American psychic who claimed to channel answers to questions on subjects such as health, astrology, reincarnation, and Atlantis while in a kind of sleep trance. Cayce's methods involved lying down and entering into what appeared to be a trance or sleep state.

Trance has been shown to be very psychologically beneficial, by helping to relieve built up stress, allowing one to reflect on life issues without censorship or guilt, and generally giving the psyche respite from operating at alpha or delta states.

Scientific disciplines

Convergent disciplines of neuroanthropology, ethnomusicology, electroencephalography, neurotheology and cognitive neuroscience, amongst others, are conducting research into the trance induction of altered states of consciousness resulting from neuron entrainment with the driving of sensory modalities. Spirit guide

Trance mediumship

Trance mediumship is often seen as a form of mental mediumship. BEGINNING this Sunday, three dwarves will work their powers against 14 of the 15 justices of the Supreme Court, a dismissed judge has warned as he filed his third motion for reconsideration for his reinstatement before the high tribunal. Judge Florentino Floro Jr. of the Malabon regional trial court was separated from service after medical findings showed that he was suffering from psychosis. The high court had said that Judge Floro lacked the judicial temperament and the fundamental requirements of competence and objectivity expected of all judges. It said that the findings of psychosis by the mental health professionals assigned to his case indicated gross deficiency in competence and independence.

The Philippine Supreme Court removed Florentino Floro Jr. from his position as a judge, primarily because of his belief in and consultation with supernatural beings (elves). Since then, he has been trying to get his post back, apparently through threats of really bad stuff that might happen to those who oppose his reinstatement, or who seem to oppose him in other ways, it seems. The Supreme Court hasn't backed down so far, though. The former judge says his beliefs in Armand, Luis, and Angel (the elves) have never interfered with his ability to dispense justice. The Supreme Court says "its medical clinic determined that Mr. Floro was suffering from psychosis."

Self-cherishing, psychosis & other oddities

IN LIFE, we encounter a lot of oddities and beg for the sublime task to render the same into linguistic idioms. If we say that he is an “odd man out,” the interpretation is as varied as the hues of the rainbow jealously misted by the dark nimbus cloud. No less than “The Wall Street Journal,” in its September 17, 2007 issue and bylined by James Hookway, featured the dismissed judge who claimed in an interview that: “It shouldn’t matter what I believed in, whether it’s Jesus, Muhammad, or Luis, Armand, and Angel.”

What the former judge said is equivalent to “self-cherishing” as the fundamental concept of the Buddhist’s philosophy on “how to enhance cherishing love.” In writing the verdict dismissing the judge, considering him as suffering from psychosis largely because of his belief in the supernatural, Associate Justice Minita Chico-Nazario said he has “his broad faith in mysticism and supernatural phenomena.” “Lest we be misconstrued, we do not denigrate such a belief system...However, such beliefs, especially since Judge Floro acted on them, are at odds with the critical and impartial thinking required of a judge under our judicial system.”

SC to probe TRO fixers, justices in appeals court

THE Supreme Court has ordered an investigation into the alleged indiscriminate issuances of temporary restraining orders by 12 Court of Appeals justices, dubbed the “dirty dozen.”

In a one-page resolution of the SC en banc, the Court ordered the Office of the Court Administrator (OCA) to appoint a judicial supervisor that would audit the cases heard by CA Justice Romeo Barza, who is suspected of being among the “dirty dozen.”

The Court issued the ruling based on a 23-page verified disbarment complaint/letter affidavit of former Malabon RTC judge Florentino Floro Jr. before the SC for charges of gross misconduct, gross ignorance of the law, manifest undue interest, questionable temporary restraining orders, grave violations of Republic Act 6713, or Code of Conduct and Ethical Standards, against the members of the “dirty dozen” and CA Justice Romeo Barza.

Barza was a former PJA president and a former senior partner of the Carpio Villaraza Cruz Angangaco law.

The SC also ordered the “designated judicial supervisor to submit a report to the Office of the Court Administrator within 30 days from date of investigation.”

Floro also asked the Court to conduct a judicial audit and preventive suspension against the “dirty dozen.”

The “dirty dozen” of the appellate court is composed of 10 male justices and two lady justices, who are on the list of alleged corrupt magistrates in the CA, according to Ombudsman Merceditas Gutierrez.

The CA is composed of 69 justices, 51 of which are stationed in Manila. Majority of these justices came from the lower court.

Flora based his case against Barza on the justice’s “frequent” issuances of TROs as reported by lawyer Mercedita G. Dadole-Ignacio, CA Cebu Division Clerk of Court to CA Clerk of Court lawyer Elisa Pilar-Longalong, according to the complaint.

Barza issued five TROs from January 18 to February 26, 2007, or a series of five TROs for five consecutive weeks, the complaint said.

Based on records submitted by the 23 Divisions Clerks of Court of the appellate court, the most number of TROs issued was by Barza, during his stay at Cebu CA. Barza is now with the CA in Manila.

The TROs were issued in connection with the cases of Sun Life of Canada v. National Labor Relations Commission, Armed Forces of the Phils. v. Yolanda Lauron, Doloreich A. Dumaluan v. Ombudsman Merceditas Gutierrez, Assumption Iloilo v. Fedy T. Bhuiyan and O.G. Holdings Corp. v. Environmental Management Bureau.

Floro also prayed that upon due notice and hearing, “judgment be rendered dismissing respondents from service, with prejudice and recommending the filing of criminal charges against them for violations of R.A. 6713 and R.A. 3019 [antigraft and corrupt practices act], and under R.A. 1379, or Forfeiture of Illegally Gotten Wealth.”

He cited pertinent laws that were violated such as the violation of the Code of Judicial Conduct, Code of Professional Responsibility and the Revised Administrative Code of 1987.

Recently, the Supreme Court set an example by sacking CA Associate Justice Elvi John Asuncion due to delays in resolving the motions for reconsideration within the required period and the irregular issuance of a TRO.

The Philippine Star 03/22/2007 The allegations of corruption in the judiciary are not new. What’s new is that four election lawyers representing different political groups have banded together and come out in the open to denounce what they said was corruption among certain trial court judges handling electoral protests. The four claimed the going rate for a favorable decision on a poll protest ranged from P1 million to P5 million. Apart from monetary considerations, political pressure can also influence court decisions, the lawyers said. They did not name names or point to a specific case of justice for sale, but it was evident that they were speaking from personal brushes with corruption.

Yesterday Chief Justice Reynato Puno met with the lawyers and ordered the implementation of measures to plug opportunities for corruption in the resolution of poll protests. The move is welcome but so much more needs to be done. Judicial corruption taints more than just election cases. Joseph Estrada famously denounced "hoodlums in robes" back when he was the vice president and chief crime buster. Now the deposed president is himself on trial for massive corruption and the hoodlums in robes are still around. They sell TROs or temporary restraining orders to the highest bidder. If the price is right, they release accused drug traffickers and other defendants in non-bailable offenses. And as the lawyers have pointed out, political considerations also taint the judiciary.

With an eye to a promotion or better assignment, judges give in to pressure from the executive branch and politicians. The rule of law is a bedrock of democracy. And that bedrock depends on a clean and efficient judiciary. That kind of judiciary has not been seen in this country for decades. Two people power revolts failed to make a difference; the TRO gained notoriety as an instrument of judicial corruption during the past two decades. Now lawyers have gone public with allegations of corruption in the judiciary that in turn tarnishes the electoral system. Even if those allegations do not lead to a purge, they should produce long overdue reforms to excise the rot in the judicial service.

Ex-judge charges CA ‘Dirty Dozen’

A former judge has filed administrative charges against 12 justices of the Court of Appeals who are on the Ombudsman’s list of magistrates under watch for corruption.

In his complaint to the Supreme Court, former Malabon Regional Trial Court Judge Florentino Floro Jr. identified only one justice and asked the Court to compel Ombudsman Merceditas Gutierrez to submit the rest of the names on her list.

Floro named only Justice Romeo Barza, a former president of the Philippine Judges Association and senior partner of the Carpio Villaraza Cruz Angangaco law office.

In his 23-page Verified Disbarment Complaint Floro charged the 12 with gross misconduct, gross ignorance of the law, manifest undue interest, issuing questionable temporary restraining orders and violations of the Code of Conduct and Ethical Standards.

Floro asked the Supreme Court to conduct a judicial audit on the 12 and place them under preventive suspension.

He said he singled out Barza because he believes Barza is the justice Gutierrez referred to as “a former judge known for his indiscriminate and improvident issuance of TROs.”

Floro also asked the Court to subpoena this Manila Times reporter to reveal the names on Ombudsman watchlist.

The Times had run an article on the “Dirty Dozen” in CA based on the Ombudsman’s list.

Floro said he filed the complaint in his capacity as a taxpayer.

The Supreme Court had dismissed Floro after he admitted that he consulted with supposed supernatural beings like elves in deciding cases.

He said he also based his complaint against Barza from a report by Mercedita G. Dadole-Ignacio, the Cebu CA division clerk of court, to CA Clerk of Court Elisa Pilar-Longalong.

Barza reportedly issued five TROs from January 18 to February 26, 2007, or one TRO a week.

Based on the records submitted by the 23 CA division clerks of court, Barza issued the string of TROs while assigned in the Cebu CA. Barza is now stationed in Manila.

The CA has 69 justices, 51 of which are assigned in Manila. Many of them rose from the lower courts.

One justice on the list is a former judge known for the “indiscriminate” and “improvident” issuances of TROs and is connected to a big law office. Another member is being watched for his “lavish” spending and rich lifestyle.

One magistrate is a former RTC judge in Quezon City. The two female justices reportedly has “strong connections” in the judiciary and is linked to a big law office and a gambling lord in Central Luzon. They were also seen frequenting big casinos wearing disguises.

The other justice fixes cases, with his wife acting as his agent. Another justice handles mainly labor cases.

An aging justice reportedly earned a fortune from a series of cases and loves to play golf.

The Supreme Court has begun to crack down on “hoodlums in robes” in the Court of Appeals.

It has sacked CA Associate Justice Elvi John Asuncion for delays in resolving motions for reconsideration within the required period and the irregular issuance of TROs.

complainers to name names

COURT of Appeals Presiding Justice Ruben Reyes has a challenge: name the Dirty Dozen in the appellate court and spare the innocent.

In an interview with The Manila Times, Reyes said that in order to push for the cleansing of the judiciary—and to be just to innocent magistrates—the names of the so-called Dirty Dozen or the “12 Most Corrupt Justices” must be disclosed.

“I am challenging and encouraging the litigants and the lawyers to come out in the open and to name names. This is the only way to clear the name of the innocent justices who are clean and proper in their ways,” Reyes said.

Reyes said that some of the CA justices were hurt by the reports that there were a dozen justices in the appellate court who are engaged in corruption.

The Chief CA Magistrate said that he is now pushing for reforms in the appellate court to dissuade issues that CA is becoming a corrupt office.

Part of this reform is the putting up of a “One Stop Shop” or a place where the litigants and lawyers will file their pleadings and other documents in a building near the CA gate which will put a stop to the practice of roaming around in the CA premises.

Justice Reyes has opened the “One Stop Shops.”

“The One Stop Shop will put a stop to the practice of roaming around in the CA premises. All of their transactions will be done here,” he said.

The Manila Times learned that the complaint against the Dirty Dozen filed by former Judge Florentino Floro of Malabon Regional Trial Court was sent to the Supreme Court’s Office of the Court Administrator and the Office of the Ombudsman.

Floro lodged charges of Gross Misconduct, Gross Ignorance of the Law, Manifest Undue Interest, Questionable Temporary Restraining Orders, Grave Violations of Republic Act 6713 or Code of Conduct and Ethical Standards against the members of the Dirty Dozen.

Floro is also asking the Court to conduct a Judicial Audit and Preventive Suspension the members of the Dirty Dozen. The complaint is asking the Court to order Ombudsman Gutierrez and The Times to be issued subpoenas and to submit the “Ombudsman Watchlist” which contain the names of the Dirty Dozen.

DO YOU remember a member of the judiciary the longest ever suspension of seven years before he was finally eased out of his office? What crime did he commit for his unceremonial dismissal from the bench? Well, he was considered "psychotic" or unfit for the job by cavorting with his dwarf-friends Luis, Armand, and Angel. His claim of being a psychic was damned by the Supreme Court.

This time, former Regional Trial Court Judge Florentino Floro, Jr. hit the headline by filing administrative charges against the so-called "Dirty Dozen" of the Court of Appeals.

The serious indictment against the 12 magistrates does not dwell on the mysticism or paranormal allegations through the messages of his elemental companions but on grounds of gross violations of judicial ethics embodied in the Code of Conduct and Ethical Standards. The violative conduct of the "Dirty Dozen" which definitely brings disrepute to the collegiate court has been exposed earlier by no less than Ombudsman Merceditas Gutierrez and the "moral" facts were made known to the Supreme Court Chief Justice Reynato Puno.

By coincidence, the list in the hands of the Office of the Ombudsman tally with that of the High Tribunal, detailing the shenanigans of the 12 magistrates. The former judge named only one associate justice who was then connected, as had been bared by a national broadsheet, as a member of "The Firm", in allusion to John Grisham's legal thriller of the same title. If indeed, the breaches committed by the 12 associate justices are recorded by the Ombudsman, would it not be logical to conduct a full-blown investigation in order that the whole justice system is not put on a very dark cloud? Just recently one of them from the same court was dismissed for gross ignorance of the law.

Now, we cannot say that the former judge is just vengeful for what was done to him. Or we can state that the administrative charges which demand for full accounting of the questionable acts of the "Dirty Dozen" is a product of psychotic tantrum! This well-known moral fact was headlined about a month or so ago by the same newspaper-The Manila Times. Among the serious "findings" or judicial aberrations allegedly committed by the "Dirty Dozen" is the sale of injunctive remedies like the issuance of Temporary Restraining Order, supported by the cases covered by such provisional remedies which allegedly cost the litigant at least One Million pesos!

It could be said that what the former judge is asking the Supreme Court is reasonable enough: An audit performance of the suspects and preventive suspensions until the thorough investigation shall have been finished.

It is further claimed that the associate justices who earned the unsavory complaints were former regional trial court judges. If the indictment is proven positive, then probably they were doing the same obnoxious acts before their promotion to the Court of Appeals. To borrow the language of Milan Kundera, a Franco-Czech novelist, such acts can be qualified as part of the "mathematical nostalgia". It needs no further explanation.

Of the "Dirty Dozen" are two lady justices, and one suspect, of being amoral in his judicial duties, is from the Court of Appeals in Cebu City. How this perception of corruption metastasizing in the judicial system shall surely tear into shreds the trust and confidence of the people in a government branch, supposedly the last bulwark of democracy, is a greater challenge than some of our political and social ails.

Is there no possibility of creating a high-profile investigative body by the High Tribunal, composed of men and women of proven honesty, probity, and
integrity, to conduct an in-depth inquiry equivalent to the no-nonsense approach of the Watergate scandal which forced the American president to resign?

This problem posed by the so-called "Dirty Dozen" appears to be a hard nut to crack with litigants cooperating with the suspects in the Court of Appeals would never lend their helping hands. Symbolically, if we look at Lady Justice, she is badly bruised and could no longer distinguish the "color of law" with
her sword and scale subtly stolen from her. This is calamitous if indeed an iota of truth is obtaining in this unprecedented expose on judicial corruption.

“MORE lawyers nowadays complain of corruption in the judicial system compared to 10 years ago, according to the Social Weather Stations. One out of two lawyers knows of a trial judge in their city or province who has taken a bribe but they did not report it because they could not prove it, said the SWS. In a briefing among lawyers Tuesday night, SWS president Mahar Mangahas said the perception of corruption in the various courts -- from the municipal trial courts all the way up to the Supreme Court -- has risen among lawyers in the last 10 years. "Our lawyers are more critical now than before," Mangahas told the lawyers as he presented the survey findings for the first time. The SWS polled 889 trial judges -- or 61 percent of all trial judges in the country -- and 400 lawyers from November 2003 to July 2004 to get their perceptions on various aspects of the judicial system. The last such survey was undertaken by SWS from 1994 to 1996. "As in 1995, one-fourth of present lawyers say that many or very many judges are corrupt. Although half or 49 percent say they know a case in their own city or province where a judge took a bribe, only 8 percent said they reported the bribery. The main excuse of those who kept silent is that they could not prove it," the SWS said. Among judges, only 7 percent said that many or very many judges were corrupt. The SWS said the judges' perception of the extent of corruption among court personnel was the same as in 1996. "What has increased is the proportion of judges seeing many lawyers as corrupt," it said. Mangahas said the survey showed that corruption "remains a serious problem in the judicial system but it is not cultural." "They're saying there's nothing to be done about (corruption) but it's not accepted. There's still the idealism," he said.”

Twelve justices of the Court of Appeals suspected of “selling” temporary restraining orders are now on the watchlist of the Office of the Ombudsman and the Supreme Court. Ombudsman Maria Merceditas Navarro-Gutierrez has confirmed that the justices have been the subject of numerous complaints from the litigants and lawyers. The Manila Times has learned that despite the sacking of CA Associate Justice Elvi John Asuncion, Chief Justice Reynato Puno continues to monitor the court’s magistrates. The Times was told the justices on the Ombudsman’s list are the same magistrates the Supreme Court suspects of fixing cases.

Gutierrez refused to reveal the names because she said the list was given to her confidentially. But she said that the suspect justices who are based in Manila conduct their nefarious transactions in three of the biggest hotels near the appellate court.

“OMBUDSMAN Merceditas Navarro-Gutierrez on Monday appealed to the Judicial and Bar Council (JBC) and President Arroyo to recommend and appoint better persons—in integrity, competence and character—to prevent the appointment in the Court of Appeals (CA) of people like the “Dirty Dozen” appellate justices who are known for selling TROs (temporary restraining orders) and for other corrupt practices. Gutierrez has told The Times that she has a list of the corrupt magistrates from the appellate court similar to the names which were given as information to the justices of the Supreme Court. According to an unimpeachable Times source, some Supreme Court justices are also receiving complaints about the very CA justices who are on the Ombudsman’s watch list.

The source told The Times that no formal complaint has been lodged against some of the “Dirty Dozen” and if the Court has investigated the complaints the probe is being done very discreetly with all probers sworn to strict confidentiality by the Chief Justice. On the other hand, Atty. Jose Midas Marquez, SC Public Information Office chief, in an interview over dzMM said that the Court does not a “formal list at present.” But, he said, “complaints against erring magistrates” have been received by the Court. “I cannot say categorically that there is a list or investigation. But we have been receiving some complaints. The Ombudsman can give the names to us for a formal investigation, “Marquez said. What The Times is holding is the “vital information” that some of the SC justices are receiving “bad remarks” against some CA justices who are included in the “Dirty Dozen” watchlist of the Ombudsman.

The Dirty Dozen

Nine male justices and two female justices, assigned in Manila, are allegedly on the list of the allegedly corrupt magistrates in the appellate court. The CA is composed of 69 justices, 51 of which are stationed in Manila. Majority of these justices came from the lower court before getting their promotion to the CA. “What pains us is that these CA justices came from the regional trial courts, which means that in the lower court they were already doing their corrupt practices and brought their corruption to the Court of Appeals. Kung sino pa ‘yung galing sa ibaba ‘yon pa ang corrupt,” a CA justice lamented. One of them is said to be “still young yet so corrupt” and he loves to play golf. The other one is already old and recently handled juicy cases. He was one of the justices who, according to Times source, should have refunded the payment already made to him by a litigant because he failed to produce the paying litigant’s desired resolution in due time. Both these old and young justices rose from the ranks or began their career in the lower courts.

More heads to roll - Chief Justice Reynato Puno has just set an example by sacking from the service CA Associate Justice Elvi John Asuncion for delaying the resolution of motions for reconsideration within the required period and for making irregular issuances of TROs. Puno has just told the 17 Division Chairmen-Justices of the appellate court to reform their divisions and put an end to rampant corruption in the CA, including the “TROs for sale” racket.”

“The allegations of corruption in the judiciary are not new. What’s new is that four election lawyers representing different political groups have banded together and come out in the open to denounce what they said was corruption among certain trial court judges handling electoral protests. The four claimed the going rate for a favorable decision on a poll protest ranged from P1 million to P5 million. Apart from monetary considerations, political pressure can also influence court decisions, the lawyers said. They did not name names or point to a specific case of justice for sale, but it was evident that they were speaking from personal brushes with corruption. The rule of law is bedrock of democracy. And that bedrock depends on a clean and efficient judiciary. That kind of judiciary has not been seen in this country for decades. Two people power revolts failed to make a difference; the TRO gained notoriety as an instrument of judicial corruption during the past two decades. Now lawyers have gone public with allegations of corruption in the judiciary that in turn tarnishes the electoral system. Even if those allegations do not lead to a purge, they should produce long overdue reforms to excise the rot in the judicial service.”

4. Ever since, no lawyer ever openly spoke and wrote to the Court about this serious matter of corruption in the judiciary. It is understandable, since VENGEANCE, ANGER and JUDICIAL hatred will be the prize for such endeavor. But how will the poor lawyer win in Courts if he antagonizes these corrupt judges and justices with several partners in the crime. Ultimately the attorney will have to loose clients. Now, I Judge Floro, fights and hope against hope that this Court will finally take the iron hand against these DIRTY DOZEN specified in the LIST of Justice Gutierrez.

Puno confronts CA on TROs ‘for sale’

“CHIEF Justice Reynato Puno is now facing his first major headache in the judiciary: Corruption and temporary restraining orders (TROs) “for sale” in the Court of Appeals. Puno summoned on Thursday afternoon the 17 chairmen (senior members) of the appellate court stationed in Manila and expressed his alarm on reports of corruption. According to the court members who talked to The Manila Times on condition of anonymity, the Chief Justice met justices in two. Presiding Justice Ruben Reyes and Justice Conrado Vasquez Jr., the second most senior in the appellate court, led the first batch. The third most senior member, Justice Portia Alino-Hormachuelos, led another batch. Only Justice Rodrigo Cosico was absent in the meeting with Puno. According to one source, Puno told the CA justices: “I’ll go straight to the point. I have called you because of corruption.” An associate justice said Puno was very stern during the meetings. A third justice described the Puno sermon as direct, candid and straightforward.

TROs

In the interview of The Times, Presiding Justice Reyes confirmed a dialogue with the Chief Justice on the issue of corruption, but he would not reveal details. Reyes said he would meet CA employees on Monday, during the flag ceremony, to address the problem. He will also have a breakfast meeting with the CA justices to discuss the reported sale of TROs. “I will ask the justices to meet their staff and to begin somewhere to fight corruption here,” Reyes told The Times. “Let the ax fall whoever gets hurt, in heaven’s name.” On the issue of TROs, one source said, the Chief Justice reiterated the traditional principle that “not to issue a TRO is the general rule and to issue is the exception.” Right now, the source admitted, the trend in the appellate court is “to issue a TRO is the general rule and not to issue is the exception.”
Suggestions - During the dialogues, several justices raised suggestions to stem corruption. Justice Vasquez asked Puno to name names and confront the justices who are subjects of corruption complaints to spare the innocent. Presiding Justice Reyes wanted to put up a press office inside the CA, to show transparency. He also said the media could act as the “watchdog” in the appellate court.

Cebu problems –

The Chief Justice raised the issue of corruption in Cebu station of the CA, where reports have cited some justices as having accepted bribes for favorable rulings. Puno reported asked Justice Hormachuelos, a Cebuana and a former judge in Cebu, if she was aware of the corruption in Cebu. The lady justice asked Puno to name the alleged corrupt CA members for verification purposes. It was reported that a young lawyer, who is a relative of a retired justice, is acting as fixer in the cases in Cebu.
Puno advised the CA magistrates to set good examples. “It should start from you. You must set an example against corruption. Employees are also involved. During my time there’s already a syndicate but it should not stop you from stopping it,” Puno told the CA justices.

MANILA, Philippines -- My mole at the Supreme says that Chief Justice Reynato Puno is planning to abolish the Court of Appeals branch in Cebu, and transfer it to Manila because of rampant corruption. Most justices at the CA-Cebu, which has three divisions, can be bought, reports reaching the Chief Justice said. Puno also wants all the cases decided by the CA-Cebu reviewed by the highest court because most of them could have been "tainted." If the CA is tainted, who can we trust with criminal and civil cases on appeal? But apparently because of the distance from Manila and lack of supervision, the CA-Cebu is playing hooky, said my Supreme Court mole. But why does the Chief Justice focus his sights solely on CA-Cebu, when there are also many corrupt CA justices in Manila?

ON TARGET - Nepotism at the Court of Appeals

MANILA, Philippines -- It must have taken Chief Justice Reynato Puno a lot of courage to expose the nepotism in the judiciary by issuing an order banning spouses and offspring of justices at the Supreme Court, the Court of Appeals, the Sandiganbayan and Court of Tax Appeals from the payroll of these higher courts. Beginning March 31, the employment of spouses and children of justices in the high tribunal, appellate court, Sandiganbayan and Court of Tax Appeals is deemed terminated. My sources in the high tribunal say there is not a single Supreme Court justice who has a spouse or offspring employed in his or her office. But the Court of Appeals has many. Among the prominent ones at the appellate court are Presiding Justice Ruben T. Reyes and Justice Rodrigo V. Cosico, whose wives are employed as their personal secretaries. The appellate court justices who have their children working in their offices are Hakim S. Abdulwahid, Renato Dacudao, Sesinando E. Villon, Elvie John Asuncion, Enrico E. Lanzanas, Rosalinda Asuncion-Vicente, Normandie B. Pizarro, Bienvenido I. Reyes and Juan Q. Enriquez. Dear readers, these are the honorable justices who pass judgment on ordinary mortals who happen to have cases pending in their court.

The wife of a justice, according to my sources at the appellate court, treats all minor employees as if they were her servants. The justice, allegedly upon the suggestion of his wife, ordered that the wives of justices wear a different uniform from ordinary employees to distinguish them from the female rank and file. For some reason, the order was not enforced.

Chief Justice seeks IBP help in stopping TROs ‘for sale’

CHIEF Justice Reynato Puno asked the lawyers in the country, through the Integrated Bar of the Philippines (IBP), to stop corrupting justices and judges and from buying temporary restraining orders (TROs) that are “for sale.” Puno made the statement with Atty. Jose Salazar, IBP national president, during their meeting with the Judicial Reform Program. Salazar said that Puno asked the lawyers’ hierarchy to cease from giving “bribes” to the members of the judiciary. The Chief Justice is worried about the growing practice of “buy and sell” of cases in the judiciary which forced him to summon the Court of Appeals justices and the officials of the lawyers’ league. Salazar said that Puno is pointing out that corruption is a two-way traffic, for there would be no acceptor if there were no bribe-giver. This would be translated into the crime of direct or indirect bribery of the magistrate and corruption of public officials on the part of the lawyer. “It takes two to tango in committing corruption. It is true that there are no corrupt judges if there are no corrupt lawyers,” Salazar said. Puno is more concerned right now with the appellate coourt, being his former court before becoming a Supreme Court Justice, than any other courts due to the complaints he is receiving that corruption is now rampant in the appellate court.

Lawyer’s style - Several lawyers in the country are engaged in corrupting judges or justices in order to win a case. A former justice secretary who talked to The Manila Times on condition of anonymity, said that the usual procedure in order to win a case pending before the courts, even in the prosecutor’s level is to broker first. The words “budget” and “mobilization fees” were normally used in law practice. “A lawyer would normally go to your office, especially if you have known each other already and will say ‘may budget yan.’ Kahit ayaw mo hindi mo naman maipahiya dahil kakilala mo,” the former secretary said. They would at times go to the chambers of magistrates or asked for a middleman.
Remedies of the bar- Salazar told The Times the accusations of corruption is a “perception,” whether it is true or not it needs to be proven by evidence. The remedy seen to cure this issue is to report the corrupt lawyers and file the necessary disbarment case.
Salazar argued that small-time law offices that wanted to establish a name could be behind the use of so-called “Matrix,” but not the big law offices. Barza as specific respondent in this case, complainant submits this CRITICAL NEWS REPORT which singles him regarding RECORD TRO issuance; while in itself it appears not irregular, still, in view of the surrounding circumstances of the audit, specifically, his RECORD in the 1st Quarter, ERGO, complainant accuses him on the legal grounds of –

a) RES IPSA LOQUITUR and b) Gross Ignorance of the Law on TRO: Improvident, dubious and questionable GRANTS thereof contrary to the established jurisprudence and circulars, coupled with c) manifest partiality, bias and undue interest or haste, considering the circumstances of the person, place and time, and d) Ignorantia juris non excusat.
Ignorantia juris non excusat or Ignorantia legis neminem excusat (Latin for "ignorance of the law is no excuse") is a public policy holding that a person who is unaware of a law may not escape liability for violating that law merely because he or she was unaware of its content; that is, persons have presumed knowledge of the law. Puno orders inventory of TROs issued by appeals court

THE Supreme Court will inventory all temporary restraining orders issued by the Court of Appeals from January determine if some justices and court employees had “sold” the TROs. The inventory was revealed by Chief Justice Reynato Puno in an interview with The Manila Times. Supreme Court Judicial Reform Program Administrator Evelyn Dumdum has asked Elisa Pilar-Longalong, the Court of Appeals’ clerk of court, to audit the TROs issued beginning last January.

Longalong informed the Supreme Court there were 68 TROs issued during the period. Based on the records submitted by the clerks of court of the CA’s 23 divisions, the biggest number of TROs was issued by Associate Justice Romeo Barza when he was still assigned in Cebu. Barza has since been stationed in Manila. In the report of Mercedita G. Dadole-Ignacio, Barza issued five TROs from January 18 to February 26. The orders involve the cases of Sun Life of Canada v. National Labor Relations Commission, Armed Forces of the Phils. v. Yolanda Lauron, Doloreich A. Dumaluan v. Ombudsman Merceditas Gutierrez, Assumption Iloilo v. Fedy T. Bhuiyan and O.G. Holdings Corp. v. Environmental Management Bureau.

CA Presiding Justice Ruben Reyes sees nothing wrong in issuing TROs, but said it is different when there is money involved. Puno has summoned the chairmen of the 17 divisions of the CA and ordered them to solve the growing corruption in the Court. The Times has learned that political and administrative cases decided by the Office of the Ombudsman were a primary source of corruption in the CA.

The son of a well-known retired Supreme Court justice has a lot of judges and justices in his “stable.” One of these judges plays golf with the lawyers of litigants. During rounds of golf, negotiations and arrangements are made.

Another contact, a Court of Appeals justice, most recently had a serious medical problem. After that problem, in which this magistrate claims to have a “spiritual reawakening,” his “asking price” for a case to be settled in his division has trebled. As for that son of the prominent retired high court justice, I wonder if his father knows what he’s doing.

MANILA, Philippines -- The Supreme Court is reportedly investigating the activities of the so-called “Dirty Dozen” at the Court of Appeals, my sources told me. The “Dirty Dozen” are justices who demand bribes from litigants whose cases have been elevated to the appellate court.
The Crusade Against Violence-Visayas chapter has written the Supreme Court through Christopher Lock, court administrator, expressing support for the plan to abolish the Court of Appeals branch in Cebu.

“We have received a lot of information about this ‘justice for sale’ corruption issue,” said Thelma Chiong, the group’s national vice president. “It may not be a cause for wonder that Visayas magistrates, whose wives hail from the Visayas, prefer to be appointed to the Court of Appeals-Cebu,” Chiong added. “Should the worst come that you decide to abolish the Court of Appeals-Cebu for justice’s sake, you have our full support,” she added. The CAV-Visayas Chapter is just one among many groups that have complained against the alleged corruption in this particular court. I’ve talked to a lot of lawyers in Cebu who confirm the blatant corruption there. “The corruption among the justices (in Cebu) makes one retch, Mon,” said a lawyer who has cases pending in the appellate court.

Invoking the Demetria ruling that newspaper reports can trigger the filing of administrative complaints even without the benefit of formal complaint, complainant implores the benevolence of this Court to forthwith docket this complaint and Order Justice Gutierrez and Jomar Canlas to tell, submit, and file the 12 names, to testify and perform their duties as officer of the Court with sworn duty under her oath as lawyer and as journalist, respectively, so that respondents would be forthwith prevented from peddling more court processes, to the irreparable injury of the litigants and the legal profession.

b. professional indiscretion, violation of oaths of offices and their duties as attorneys or counselors-at-law, which include the statutory grounds enumerated under Sec. 27 of Rule 138, Rules of Court (Arrieta vs. Llosa, 282 SCRA 248), including grossly unethical behavior, bias, prejudice, extreme partiality, malice and bad faith in the proceedings regarding their litigants’ cases, inter alia,
c. grave VIOLATIONS of ---

i. Sec. 20 (a), Rule 138, Rules of Court,

Canons 1, 1.01, 1.02, 1.03, 2, 2.01, 2.03, 2.04, 3, 3.01, 3.02, & 3.10, Code of Judicial Conduct – in that they miserably failed to be the embodiment of competence, integrity, and independence; they failed to have administered justice to complainant impartially and without delay; they failed to have resisted pressure and influence of their co-conspirators/detractors (due to his ardent desire to be promoted, for power, lust for glory, money); they did not behave to promote public confidence in the integrity and impartiality of the judiciary; they conveyed to the public, an impression that they were so powerful/in a special position to influence others; they failed to follow the strict mandates of Rules 140/138, Rules of Court, and the Bill of Rights, RULE OF LAW/ADMINISTRATIVE due process/rule of law; they failed to diligently ascertain the facts and the applicable law in the said administrative proceeding; they failed to maintain professional competence;
iii. Canons 10, 10.01, 10.03, 11 & 11.04, Code of Professional Responsibility, as lawyer/counselor ---
they did falsehood, attempted to have converted their hearings and proceeses of litigants into Moro-Moro, a farce so to speak; they misused the law and rules to defeat the end of justice; R.A. 6713, Code of Ethical Standards for Government Officials --- the ethics and professionalism required of them by its circulars;

iv. Revised Administrative Code of 1987 as amended, on their oppression, bad faith/malice; The Civil Service Law, rules and regulations, including the constitutional mandate that “public office is a public trust, public officers shall serve with the highest degree of responsibility, integrity, efficiency, xxx.” (Businos vs. Ricafort, 283 SCRA 407).

These violations/acts and omissions of respondents definitely show them to be wanting in moral character and probity/good demeanor or unworthy to continue as officers of the Court, or unfit or unsafe person to enjoy the privileges of attorneys or for conducts which tend to bring reproach on the legal profession or to injure it in the favorable opinion of the public. They clearly demonstrated attitudes and courses of conduct wholly inconsistent with the approved professional standards, of having failed to live up to their duties as lawyers in consonance with the strictures of the lawyer’s or judge’s oaths, and the cited Canons and Codes, thereby having occasioned unwarranted sufferings and humiliations and hardships on litigants. They were propelled by ill motives and malicious intentions, coupled with greed and lust for money, power or promotion, having failed in conscientiously seeing to it that justice permeates every aspect of their duties and profession, in conformity with the avowed duties of worthy members and officers of the Bar and the Bench.

Locus Standi

1. Complainant is a Filipino Citizen, a taxpayer, and a registered voter of 123 Dahlia, Alido, Malolos, Bulacan, his home and postal address, where he may be served with court processes, orders and judgments.

2. As a citizen, taxpayer and registered voter, undersigned has LOCUS STANDI or legal standing to file this case, is an interested / real party-in-interest and has direct, special and extra-ordinary interest in the subject matters of this landmark case.

NATURE, SPECIAL PURPOSE AND TRANSCENDENTAL VALUE OF THE COMPLAINT; GENERAL, SPECIAL AND DIRECT INTERESTS OF PETITIONER IN THIS CASE; IRREPARABLE INJURY TO THE NATION / COMPLAINANT

The matter is a delicate one, quite obviously, and must thus be dealt with utmost circumspection, to avoid any FURTHER question regarding the immense, rampant and unprecedented corruption in the Court of Appeals which had never been exposed, published and seen since 1901.
The issues posed by the petition / complaint transcend the persons of complainant, necessary parties and respondents. These issues affect some of our most deeply held values in democracy --- the protection of civil and judicial rights, the tarnishing and perhaps total destruction of the judicial department/our temples of justice. The petition and complaint at bar concern all these values. It is the people on the line. It is we.

3. RIGHT TO INFORMATION: As a citizen, taxpayer and registered voter, complainant has a constitutional right to information on all matters of public concern, not the least of which are the names in the watch list of Justice Gutierrez duly published in the said papers. She and Jomar Canlas cannot in the name of confidentiality (of the names given to them by John Doe informer) refuse nor delay the PUBLIC DISCLOSURE of their names in the list. THIS COURT OF LAST RESORT has the moral and legal DUTY under its traditional and historical name BULWARK OF DEMOCRACY, to order her and Canlas to submit the names in this case, and forthwith. These 12 dirty jurists must be tried and removed under the Constitutional mandate. Complainant hereby asks this PUNO Court to leave a LEGACY of TRUTH and PUNISHMENT of hoodlum in robes, MERCHANTS of injustice and evil. We demand nothing less.

Last February, Malacañang announced her appointment to the Supreme Court, Sandiganbayan Justice Minita Chico-Nazario went to see Chief Justice Hilario Davide to take her oath as a Supreme Court justice. But she was told by Davide that Malacañang had not forwarded her appointment papers to the high tribunal. She also had nothing to show to Davide.It turned out that Malacañang recalled her appointment.

SANDIGANBAYAN Presiding Justice Minita V. Chico Nazario has been sworn in as the newest member of the Supreme Court. In a simple oath taking ceremony held in Malacang, President Gloria Macapagal Arroyo formally installed Justice Nazario as the 14th Associate Justice, filling in the vacancy created with the retirement of Associate Justice Josue N. Bellosillo.

The new Associate Justice is a native of San Miguel, Bulacan, and is married to Rodolfo Nazario with whom she has three children. Rod Nazario said his wife had felt so bad about the apparent withdrawal of her appointment that he had to take her to Baguio last week.He said he did not bring up his wife's hurt feelings to the President. "Maybe she does not know that I am the manager of Manny Pacquiao," he said.

He also said he could not believe that Ms Macapagal would be influenced by a law firm into withdrawing his wife's appointment. Floro was sacked last month and fined $780 (40,000 pesos) after a three-year investigation found he was incompetent, had shown bias in a case he was trying and had criticized court procedure, a ruling showed.

LUNACY on the Bench is not as common as prime ministers and home secretaries stung by judgments critical of their policies like to suggest. The recent decision of the Supreme Court of the Philippines to dismiss Judge Florentino V. Floro Jr as a judge of the Regional Trial Court in Malabon City because of a “medically disabling condition of the mind” that rendered him “unfit to discharge the functions of his office” repays careful consideration by any student of the judiciary.

Judge Floro first applied for appointment to the Bench in 1995. The mandatory psychological evaluation by the Supreme Court Clinic Services (memo to the Lord Chancellor: do not even consider this) revealed “evidence of ego disintegration”. Judge Floro voluntarily withdrew his application. He reapplied in 1998, but the evaluation was again negative, identifying problems with self-esteem and mood swings. But Judge Floro was allowed to rely on a more favourable assessment from private practitioners. He began work as a judge in November 1998.
The appointment was not a great success. Less than eight months later, the Supreme Court suspended Judge Floro while complaints against him were investigated. It took nearly seven years to complete the inquiries, partly because of the delaying tactics by the judge. In March Justice Chico-Nazario, for a unanimous 14-strong Supreme Court, decided that Judge Floro should be dismissed from the Bench.

In 1890 Mr Justice Stephen became incapable of acting in a judicious manner by reason of mental illness. And in the 1950s, a High Court judge who lost his faculties was persuaded to resign only when no work was assigned to him. But there is, I think, no precedent for Judge Floro’s unusual manner of opening proceedings in his courtroom. A formal, “All rise”, or even a jocular, “Here comes the judge”, might be acceptable. But not the introductory statement to all those present in court that Judge Floro was “a Bar topnotcher” who passed the 1983 Bar Examinations “with an average score of 87.55 per cent”. There would follow a reading from the Bible, after which Judge Floro would answer questions on the scriptural text of the day. The judge’s visiting card also stated that he was a “Bar exams topnotcher (87.55 per cent)” with “full second honours”. As the Supreme Court concluded, litigants might well interpret all this “as a sign of insecurity”.

What caused the Supreme Court most concern, and who can blame them, was Judge Floro’s belief that he enjoyed qualities lacked by other members of the judiciary. Judge Floro is not the first judge to have an inflated opinion of his own abilities, but there are not many who have claimed special powers as “the No 5 psychic in the country”. (The Supreme Court judgment unfortunately provides no information on whether the top four also have legal qualifications and, if so, what marks they obtained in the Bar exams.) In a variation of dress-down Fridays, Judge Floro changed from blue court robes to black each Friday “to recharge his psychic powers”. He was, he suggested, the angel of death and able to inflict pain and sickness on people appearing in his court (a valuable but perhaps disproportionate sanction in dealing with vexatious litigants).

The judge believed that he could write while in a trance, and he had, he insisted, “been seen by several people to have been in two places at the same time”, a very useful attribute in reducing the waiting lists for pending cases. Most impressive of all, Judge Floro had made a covenant with “three dwarf friends named Luis, Armand and Angel”, who would, unseen by others, provide him with assistance in court (presumably when counsel were unable to provide a page reference in the bundles of evidence).

Very generously in the circumstances, the Supreme Court emphasised that it was not ruling that Judge Floro was insane. He was merely suffering from a psychosis that appeared to “cloud his judgment” and so undermined his competence and objectivity. Justice Chico-Nazario concluded that psychic phenomena, “even assuming such exist” (a wise judge never decides more than is necessary to dispose of the case), have no place in jurisprudence. Though it would, I suppose, be helpful to be able accurately to predict how the Supreme Court would deal with a case, and so avoid the expense and delay of waiting for their decisions.

The Supreme Court let Judge Floro down from the Bench as lightly as possible. No one is to blame as “we cannot condemn people for their faulty genes and/or adverse environment — factors they have no control over”. Judge Floro “may be dysfunctional as a judge” but “may still be successful in other areas of endeavour”. Especially, of course, as he can rely on the help of those three dwarf friends.

The persecution of the psychically gifted continues. Judge Florentino Floro, who until recently presided over a jurisdiction in suburban Manila, was removed from the bench on "administrative grounds" because of prejudice against those who have the ability to see the future and conduct supernatural healing sessions in chambers. Judge Floro also apparently started each court day with a reading from the Book of Revelations, which is just the kind of thing you want to hear before trying to plead down a traffic ticket.

Judge Floro also said he had made a covenant with "dwarf friends" -- who hasn't? -- and claimed a variety of other supernatural abilities.

The country's Supreme Court ruled that, assuming for the sake of argument that psychic phenomena did exist, they had "no place in a judiciary duty-bound to apply only positive law." The court stressed that Floro was not guilty of any misconduct or corruption, but found that he did have "mental problems" that rendered him "unfit for the delicate task of dispensing justice." For now, maybe, Supreme Court, but when the moon turns blood-red and the Beast with ten heads and seven horns reveals itself, then you guys are really up shit creek without Floro around, that's all I can say.

I previously reported on Judge Florentino Floro, a judge in the Philippines who was removed from the bench recently for acts as innocuous as fortune-telling, faith healing in chambers, and beginning each court session with a cheery reading from the Book of Revelations. He also said he had made a covenant with "dwarf friends," but little was known about these friends until this week.

Floro was back in the news because he is appealing the ruling by the country's Supreme Court removing him from office. The grounds are discrimination against people who tell fortunes, heal people, read from Revelations and make covenants with mystic dwarfs. (Also, he "criticized court procedure," probably the last straw.) "They should not have dismissed me for what I believed," Floro told reporters after filing his appeal.

According to the court, it did not dismiss him for what he believed, it dismissed him for believing something that was nutty. A court-appointed expert found that Floro was suffering from psychosis and the court agreed, partly because of the above and also because of new revelations about the role of the "mystic dwarfs." Of which there were three, named "Armand," "Luis" and "Angel." Their end of the covenant was apparently to help Floro conduct his healing sessions, because as you know faith healing is way more difficult without a mystic dwarf or two around.
Experts predict that Floro's appeal will be granted never.

At 2:00 pm, Estrada releases a letter saying he had "strong and serious doubts about the legality and constitutionality of her proclamation as president", but saying he would give up his office to avoid being an obstacle to healing the nation.

The EDSA Revolution of 2001, also called by the local media as EDSA II (pronounced as EDSA Dos or EDSA 2) or the Second People Power Revolution, is the common name of the four-day popular revolution that peacefully overthrew Philippine President Joseph Estrada from January 17 - January 20, 2001.

He was succeeded by his then vice president Gloria Macapagal-Arroyo. EDSA is an acronym derived from Epifanio de los Santos Avenue, the major thoroughfare connecting the five cities in Metro Manila, namely Pasay, Makati, Mandaluyong, Quezon City, and Caloocan. The revolt took place in the business district of Ortigas Center.

The newspaper reported the DISBARMENT case A.C. # 5286 filed by Philippine Psychic Judge Floro against former Court Administrator Alfredo L. Benipayo. Judge Floro accused Benipayo of a) signing the 85 pages July 13, 1999 Recommendation of Preventive Suspension Memorandum Complaint (which resulted in the longest suspension in world judicial history: 7 years on July 20, 2006) without any private complainant, and b) submitting the 13 administrative charges without due process of law (not allowing Judge Floro to file comment, and to have the case docketed as OCA IPI, or for preliminary investigation).

"A LOWER court judge suspended by the Supreme Court (SC) has asked the high court to allow Sandiganbayan anti-graft court magistrate Minita V. Chico-Nazario to take her oath of office to fill the vacancy in the SC. In a 22-page petition, Judge Florentino V. Floro Jr., who has been suspended as a Malabon regional trial court (RTC) magistrate, also asked the court to exclude Solicitor General Alfredo Benipayo from the list of nominees for the position.

The judge pointed out that under the charter, any SC vacancy shall be filed within ninety days two months immediately before the next presidential elections. The controversy over Nazario, Floro said, "transcends the person of Nazario… (and) affects some of our most deeply held values in democracy--the protection of political and judicial rights, the disapprobation of political loyalty in our temples of justice and elimination of all invidious discrimination in the JBC nomination process." Floro has been preventively suspended by the SC for more than four and a half years for gross ignorance of the law, rules and canons.

A suspended judge, however, filed a petition asking the SC to declare Sandiganbayan Presiding Justice Minita Chico-Nazario as the duly appointed justice to the high tribunal.

Judge Florentino Floro Jr., who presided over the Malabon regional trial court and was suspended for various administrative offenses and alleged psychological and mental disorders in 1999, said Nazario should be enjoined from performing her duties as Sandiganbayan presiding justice and immediately be administered a "directory oath of office" as the 15th SC justice.

Floro said there was no need for Nazario to be formally inducted, since her appointment was already complete and announced to the public.

Acting Justice Secretary Merceditas Gutierrez said the President can no longer make any appointments, as the Constitution provides that "two months immediately before the next presidential election and up to the end of his term, a President or Acting President shall not make appointments, except temporary appointments, to executive positions when continued vacancies therein prejudice public service or endanger public safety."

But the JBC will still tackle the issue and determine how it will be resolved despite the ban on appointments, Gutierrez said.
For his part, Pangilinan said the President should be given some leeway in her exercise of her power to appoint an SC justice.

"There may be information regarding any of the nominees that could have come to President Arroyo’s attention," he said. "This could be information that members of the JBC are unaware of that need (for) further confirmation or verification on her part, hence the need for additional time for her to come to a decision regarding the said appointment."
"But without any proof of the unjustified cause for delay, there is no impeachable offense," Pangilinan said.

Meanwhile, Floro also asked the Supreme Court to nullify the JBC’s nomination of Solicitor General Alfredo Benipayo to the "short list" of SC candidates.

Benipayo, as former court administrator, was the one who recommended the indefinite preventive suspension of Floro for various offenses, including predicting former President Joseph Estrada’s downfall and illnesses among his staff, believing in dwarves and the "angel of death" and for wearing dark blue robes instead of the traditional black robes worn by judges."

Judges and Dwarfs Don't Mix

Judges are, by and large, not the flamingos of the justice swamp. Present company excluded, we tend to be temperate, conservative and ... well, judicious. For every one of us who wears Hawaiian shirts and cowboy boots to work, there are scores wearing rep ties and wing tips. That's just how we are. It's also how we got here.

I've been watching this system for 35 years and I've pretty much concluded that the first question — maybe not the most important one, but the first one — the governor asks about any judicial candidate is, "What are the chances I'll ever see this person's name again if I appoint him/her?" Only if the appointments secretary answers, "Zero. No chance. Zip, zilch, nada, bupkis, ain't gonna happen; fuhgeddaboudit" does the process go any further.

Every quarter the Judicial Conduct Reporter lands on my desk and I put aside whatever I'm working on to read it. Talk about psychotherapy. Forget Brandeis and Cardozo, I feel like Gandhi. The things other judges are doing make me want to call Davies and ask what took him so long!

Usually the Judicial Conduct Reporters have a theme. Usually it's sexual harassment. Sexual harassment seems to be the judicial equivalent of the common cold. But there are other themes: bullying people, inappropriate gifts, ill-advised charitable activities. One of my favorites was "Judicial Road Rage."
This was a collection of guys who didn't just yell at another motorist or flip them off, but had them arrested. These people actually sent their bailiffs out, or called the sheriff, and had motorists whose driving offended them tossed into the hoosegow. Not just one guy who did that, several of them! A gaggle! At the risk of sounding provincial, most of these do not involve California judges. Whether it reflects strong moral fiber or mere lack of imagination, our judges don't seem as prone to things like making decisions by flipping a coin (summer 2003) or falsely claiming to have won the Medal of Honor (summer 1995).

Nor do we talk to imaginary mystic dwarfs. Yep. That's what it says: imaginary mystic dwarfs. Until today, I would not have considered my lack of involvement with imaginary mystic dwarfs a great achievement. Until today, I would not have understood it as a compliment if someone said, "I've got some issues with Bedsworth; about the best thing I can say about him is he doesn't talk to imaginary mystic dwarfs."

But today I found out the mystic dwarf thing is grounds for removal of a judge in the Philippines. According to Reuters, "A Philippine judge who claimed he could see into the future and admitted consulting imaginary mystic dwarfs has asked for his job back after being sacked by the country's Supreme Court." Wow. I'm too old to use the word "awesome," but I just don't know how else to describe that. As judicial flameouts go, that's Krakatoa.

My hat's off to former-Judge Florentino Floro and his ... uh ... staff.

This beats the hell out of anything the Judicial Conduct Reporter's come up with lately. And I just love it. I love it because it appeared when I was right up against my deadline. I love it because it makes me feel superior. I love it because I've never previously gotten to type the phrase "imaginary mystic dwarfs." And I love it because the guy is APPEALING! As near as I can determine, he's making this out to be a freedom of religion issue. He says, "They should not have dismissed me for what I believed." Certainly, I can sympathize with that position.

The prospect of judges being removed because of their personal belief systems is anathema to all of us.

But I think once it's established that you, "told investigators that three mystic dwarfs — Armand, Luis and Angel — helped you carry out healing sessions during breaks in chambers," you gotta expect to trudge through a little grief. I mean, these aren't just your ordinary, garden-variety, run-of-the-mill imaginary mystic dwarfs. These are imaginary mystic healing dwarfs! And you're on a first-name basis with them. You gotta expect the local bar to be a little leery when you tell 'em, "Counsel, I regret that I cannot grant your motion. But if you'll just step into chambers, me and Luis and Armand will use our mystic powers to cure that arthritic knee of yours." You've especially gotta expect it if you're able to see into the future.

Reuters doesn't elaborate on just what the judge could see in the future — or whether Armand, Luis and Angel were not only mystic and therapeutic, but precognitive as well — but I'm not sure saying you can see into the future requires much elaboration. Certainly it made Judge Floro's future pretty clear. I have no doubt that if I had told ANY of the lawyers who appeared before me, EVER, that me and the mystic healing dwarfs were gonna cure a little deafness and then go out for a run over the lunch hour and that when we returned we'd have the name of next year's Preakness winner, Davies would have docked me some points.

Certainly the Philippine Supreme Court thinks it lowers your score. Although they were very diplomatic about it. According to Reuters, "The Supreme Court said it was not within its expertise to conclude that Floro was insane, but agreed with the court clinic's finding that he was psychotic." I'm not sure just what distinction they were drawing here. They may have been saying, "We're not psychiatrists, so we can't say he's gone stark, staring loony tunes on us, but we certainly agree with the doctors who said it." Or they may have concluded that, in today's world, one psychosis hardly differentiates you from the rest of society; it takes at least two or three to qualify for a diagnosis of insanity.

Either way, they confiscated his robe and his ruby slippers and fined him $780.

And, mirabile dictu, Judge Floro is appealing. I don't have a clue who to. Who do you appeal to after the Philippine Supreme Court disrobes you? Seems to me, you and the dwarfs have pretty much topped out when you lose in your nation's supreme court. I can't really see The Hague taking this one on. But Judge Floro has vowed an appeal, and, since he can see into the future, I have to assume it's gonna come to pass. And I'm not about to take a chance that I might miss the outcome of this saga. I'm going online as soon as I finish writing this to subscribe to the Philippine Judicial Conduct Quarterly. Then I'm gonna contact the dwarfs and see if they can do anything about my putting.

Having read Judge Floro's posting on this blog, I am inclined to revise my suggestion. In his case I think sixteenth century Spain would be a far better choice than contemporary Iceland. Icelandic elves, at least in so far as I can judge from the available literature, have little or nothing in common with avenging angels and similarly disposed spirit guides. Torquemada, on the other hand, might have found a use for Judge Floro's unusual capabilities.

I think perhaps that what Judge Floro needs is a simple change of venue. Consider Iceland, where government agencies consult maps identifying the location of elf-abodes before siting projects (a google search will readily turn up articles by Rolf Soderlind of Reuters, Colin Nickerson of the Boston Globe, and Sarah Lyall of the New York Times (7/13/05).The consideration given in some nations to elf-habitat has prompted at least one observer to suggest that elves enjoy legal protection, or "elf rights", in both Iceland and Ireland (look for "Do Elves Have Rights" by Jeremy Harte; see also a discussion of elves in the context of a Yale Law School party at the Yale Daily News) One has to consider the possibility that in Iceland, where according to some, 10% believe outright in the existence of elves and more than half think its possible or probable, including the President (opinion poll references shows up in a number of news articles, including those by Soderlind and Nickerson) a judge professing the beliefs expressed by Judge Soro might blend right in.Come to think of it, the Ninth Circuit might want to consider a move as well.

I mentioned in the "Lowering the Bar" presentation I did two weeks ago that I had heard from Judge Florentino Floro, who I had written about twice before. You may recall that Judge Floro was dismissed (or "separated") from the bench in Malabon City, a suburb north of Manila, after questions arose about his practices of starting court days with a reading from the Book of Revelations, conducting faith-healing sessions in chambers, and consulting three "mystic dwarves" named Luis, Armand and Angel for advice and predictions of future events. As Judge Floro was a judge, that seemed to fall within the scope of this project and I did mention him a couple of times.

Judge Floro emailed me (and a number of others who had written about him) a couple of weeks ago, primarily to thank everyone for writing about his case. He noted that he was appealing his case, forwarded us some pleadings, and was kind enough to answer a few questions. Here's an (edited) summary of the answers:

LoTB: First, what is the difference between a separation and a dismissal? Is it possible you could be reinstated? If so, would you want to be a judge again? Was it fun to be a judge?

JF: Dismissal, under our laws, carries with it perpetual disqualification & DISBARMENT. . . . I believe that the laws are in my favor. But, I cannot tell you what will be their votes. . . . I would want to be a judge [again]. It is not fun, since I am honest. I had to wake up 6 am and sleep at 9pm and week ends I pen decisions; it is nightmare. But, my neighbor judges, they come to court, 10 am, deal only with juicy cases and they put in the backburner the not juicy ones; they play golf, 1 pm. This is not an exaggeration, since their staff and fixers do all the jobs.

LoTB: Second, why did the press say that Luis, Armand and Angel were “dwarves”? Was this a mistranslation of “dwende,” the mischievious spirits believed to reside in anthills (also translated “gnomes”)? Are they truly of small stature? Did they help you with your opinions, and if so, do they have any legal training?

JF: Answer: The names of my spirit guides are Luis, Armand and Angel; they are not the ordinary dwarves, gnomes, leprechauns, vulcans, . . . Luis is the King of Kings of elementals, an angel of God; if you are a Christian, you can read this in genesis,etc. and you can click angels in encyclopedia.com or wikkipedia,etc. . . In Ireland - a Catholic country - they can see dwarfs, but only the ordinary kind. LUIS IS THE KING OF ALL KINGS OF THESE. Usually, they are of small stature, but they only appear to me in the form of lights. TRUTH: I never used the word “DWARVES” in any DECISION, and I never consulted any imaginary dwarf to pen my decisions. LUIS is highly educated.

LoTB: Third, you stated that you were the fifth-best psychic in the Philippines. Who do you think are the top four, and do any of them practice law?

JF: I stated in 1998 that I believe our President Ferdinand Marcos is # 1. . . I specifically have the following gifts: cross of the tongue, lightning teeth, my eyes emit spiritual fires, and my hands emit extreme heat that heals the poorest of the poor (with heat-processed coconut oil). All of us are psychics to a degree but very few can bend spoons. I was gifted with healing, bilocation, exorcism,etc. I graduated 2nd full honors and placed 12th in our 1983 Bar Exams, 87.55% (our Bar exam is the toughest, since many aspirants here who failed 3 x could easily pass your Bar in California, please do not be offended).

LoTB: Fourth, I am very interested to know what verse or verses of the Bible you selected to begin each court day. One report stated that at least on some days these verses were from the Book of Revelations. Is that true, and what are your favorite verses from that Book?

JF: In 1998, when I assumed office . . . I asked them to read the Book of revelations, because it is the hardest book but there it is, ALL. My favorite verses of the Bible are ECCLESIASTES, there the philosophy of life’s uselessness and injustice but God will judge everything done in secret. Also, the psalms, on curses on God’s punishment versus evil.
Judge Floro and I have corresponded a few times now and he seems to be a very pleasant man who is certainly convinced of the justice of his cause. (Judge Floro, please let me know if I've misstated anything in this report.) With his permission, I did talk about him and his case at the presentation a couple of weeks ago. I think it is fair to say that people were quite interested in the matter, although there is probably not much we can do from halfway around the world.

Or at least that's what I thought. In a third supplemental pleading that Judge Floro forwarded me last night, I was a little surprised, but proud, to see that he had cited me as one of a number of worldwide authorities on his case. The pleading starts by reprinting most of an article on the case by Justice William Bedsworth, an associate justice in California's 4th District Court of Appeals, who has his own blog and who frequently publishes articles in the legal papers here as well. Judge Floro also cites (among others) another California attorney, Lester Hardy; David Pannick, a British attorney; Ken Blanchard, a management and business writer (The One Minute Manager); a French blogger; and Che Vaughn, a tarot reader and clairvoyant who shares her home with "a couple of spirits, some shadow people, some black blobs, one homunculus and a cat."

Also, Lowering the Bar, which gets about two of the thirty pages. The posts are accurately quoted, I'm pretty sure, and the biographical information on me (from our firm's website) looks right too -- I have to admit, though, that Judge Floro embellished a bit by describing me as a "celebrated" San Francisco lawyer. My dog is generally excited to see me, but that's about the only celebration I generate.

Judge Floro is asking for reinstatement and about four years' worth of back wages. As best I can tell from the pleadings, his argument is more or less that he should not have been separated from the bench just because of his beliefs, so long as he served his country and Malabon City in a fair and honorable manner. That's a fair point -- who would you rather have as a judge: somebody who takes bribes; or an honest guy who happens to have lightning teeth and well-educated spirit friends but can pass the hardest bar exam in the world? I know my answer.

I have to say though, Judge Floro, I don't know that citing the world's blog posts will add anything to to the heartfelt and very, very lengthy briefing you've already presented to the court. And you should always be careful when using sarcasm in pleadings, especially somebody else's. Also, I think a lot of practicing lawyers would suggest that there is life outside the law, and so maybe this is a good time to follow your dream of being more involved with the horses or the world of horse racing. Having said that, I wish you luck in whatever you decide to do.
